Regular contact with your dedicated case worker will ensure you are kept fully informed throughout the process and will allow you to be safe in the knowledge that you have a team of finance industry & legal professionals working on your behalf.
The key stages are:
- Through an in depth fact-find we identify your schedule of creditors & what your current monthly liabilities are.
- Detailed income & essential expenditure analysis to show in real terms why you are struggling with your monthly creditor commitments & the set up of an affordable monthly savings & repayment plan.
- Calculation of your true debt level through initial communication with your creditors – to identify the exact balances in terms of what your creditors believe they are owed.
- Identification of the debts that can be legally challenged or written off & the commencement of the legal dispute process. We do this through:
- Requesting sight of your executed credit agreements under the terms of the Consumer Credit Act 1974.
- Generating subject access requests to identify any interest or charges that may have been unlawfully levied on your accounts over the last 6 years.
- Ensure your creditors register your accounts as disputed where required and leave you alone until that dispute is resolved or face injunctive proceedings if you are being harassed off the back of legally unenforceable credit agreements.
- Ensure the return of any payment protection insurances that may have been mis-sold or incorrectly added to your accounts.
- Negotiate reduced monthly repayments & full and final settlements on your legally enforceable debt by utilising your monthly contributions & money reclaimed (your client fund).
As described above we offer a true end to end process. If an agreement or debt is not disputable, we will not just pass it back to you to worry about on your own, as you might experience with a standard claims management solution. This debt will be managed and negotiated for a suitable repayment figure either for a monthly sum or a one off full and final settlement amount.
